Insurance

Many organizations require that a homeschooling group have Liability Insurance in order to use their facilities. CHALC maintains such a policy, covering the announced activities of each of its member support groups. The Insurance policy provides coverage for CHALC, as the Named Insured, and its members as Additional Insureds for bodily injury, property damage, personal or advertising injury to a third party for which it is liable.

Negligent acts may occur for which CHALC may be held responsible. These acts may be performed by CHALC members, including volunteers and students, while involved in Association-related activities.

CHALC and its members could be held responsible for any action that results in Bodily or Property Damage to a third party. Bodily injury means someone getting physically hurt or sick or someone dying. Property Damage means that tangible property gets damaged or destroyed. Please note that there is no coverage for Bodily Injury to Athletic participants. Not every act that results in Bodily Injury or Property Damage would be covered. For example, intentional injury is not covered by insurance.

CHALC and its members could also be held responsible for Personal and Advertising Injury if a member would say or print something malicious about a third party. If CHALC or one of its members is responsible, it may have to pay for damages, and the cost of its defense. The General Liability insurance would help to defray these costs.

Common exclusions of Commercial General Liability

  • Aircraft
  • Automobiles and racing
  • Care, custody and control
  • Contracts: other than lease of premises (except damage to rented or loaned premises), easements, elevator maintenance agreements, most agreements required by municipal ordinance and railroad side track agreements.
  • Damage to your products
  • Injury to employees
  • Intentional acts
  • Liquor Liability
  • Nuclear
  • Pollution
  • Product recall or withdrawal
  • Property damage to impaired property
  • War
  • Watercraft
  • Work performed / Failure to perform
  • Workers' Compensation obligations

Facilities that you rent for events, such as a co-op activity, may request proof of insurance to show that, if CHALC or one of its members causes property damage to the facility, there is insurance to pay for the damage. In order for insurance to cover an event, the activity must be advertised in the Scrawls! Otherwise, it will not be considered a CHALC sponsored event and insurance coverage would not apply.

This is not an accident insurance type of policy. It does not take the place of someone's health insurance. In order for a claim to be paid under this policy, CHALC must be considered liable for the damage.

All further questions regarding the insurance should be directed to mail@chalc.org.
